Refund
Refund Policy Based on Incoterms 2020
Under the agreed terms of delivery, which is governed by Incoterms 2020, customer refunds will be issued under the following circumstances:
Inspection:
Should the appointed inspection company determine, at the specified time and location, that the delivered goods do not conform to the technical specifications outlined in the official documentation, the purchase will be canceled, and all prepayment will be refunded. These determinations may be based on laboratory test results, as will be detailed in the contract.
Insurance:
The type of insurance coverage and the responsible party (buyer or seller) will be determined, based on the selected term of Incoterms 2020. In the event of an insured loss, the seller can be chosen as a responsible for initiating the insurance claim, therefore, if their proofs are acceptable, the insurance company will directly reimburse the customer. These provisions will be explicitly outlined in the contract.
Late Delivery:
The contract will specify the timeline and procedures for preparing the goods for shipment from the seller’s warehouse to the delivery location. This ensures that customers can plan accordingly, while the seller can mitigate risks by including appropriate provisions in their agreements with the manufacturer, which cause they will be enforced to reimburse.
In-transit Damages:
This clause addresses issues related to damage or loss during transportation, which may be covered under either note 1 (inspection) or note 3 (late delivery) depending on the specific circumstances. It is better to be noticed that all of the related issues to transferring are completely separated before and after delivery; the former is managed by the seller and the latter is undertaken by the buyer.
Manufacturer Production Issues:
The contract will outline the remedies available to the buyer in the event that the seller unilaterally terminates the agreement due to production issues. These remedies may include financial compensation.
* It is essential to note that all of the aforementioned provisions will be explicitly detailed in the contract. The selected term of delivery and compromised conditions of the contract can impact the final price of the goods. Generally, more stringent tolerances for any item in the contract will result in higher product costs and lower risks.
